OFFICIAL RULES OF GETITFREE’S EASTER EGG CONTEST
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.
By entering into this Get it Free Easter Egg Contest (the “Promotion”), you agree and accept the terms of these Official Rules.
ADMINISTRATOR: The administrator of the Promotion is Get it Free (the “Administrator”). The Administrator will conduct the Promotion as described within these Official Rules.
ENTRY PERIOD: The Promotion begins at 12:00 PM PST on March 31, 2017 and ends at 12:00 PM PST on April 16, 2017 (the “Contest Period”).
ELIGIBILITY: This Promotion is open to legal residents of the United States in a region which participation in this Promotion fully complies with all applicable laws, who are at least eighteen (18) years of age at the time of entry. The Promotion is void outside the United States and where prohibited by law. The Administrator and each of its respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, employees, and any entity involved in the development, production, implementation, administration, or fulfillment of the Promotion, including, without limitation, the immediate family members and/or those persons living in the same household of such individuals, are not eligible to participate. All eligible individuals for this Promotion are referred to herein as an “Entrant.”
HOW TO ENTER: At any time during the Contest Period, visit http://www.getitfree.us/ to search through any part of the website, including the Freebies, Coupons, Deals, Sweepstakes, Videos, and Blog pages. Easter eggs will be planted within any portion of getitfree.us. An Easter egg may randomly appear on your screen when on getitfree.us, in which you may click on the egg to populate a form to claim the egg. You will be asked to complete all required contact information, including: your name, address, telephone number, and email address and an arithmetic question which you will be required to answer correctly.
METHOD OF ENTRY: Limited to one entry per Entrant. Proof of submission does not constitute proof of receipt. If there is a dispute as to the identity of the Entrant, the prize will be awarded to the authorized account holder of the email address submitted. The “authorized account holder” is defined as the natural person whose email address is assigned by an Internet service provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. If, in the Administrator’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if a computer virus, bug, unauthorized intervention, fraud, technical difficulties, or failures compromise or affect the administration, integrity, fairness, security, or proper conduct of the Promotion, and/or if the Promotion is not capable of being conducted as described in these Official Rules, Administrator shall have the right, at its sole discretion, to disqualify any individual who tampers with the process and/or to cancel, terminate, modify, or suspend this Promotion as deemed fair and appropriate by Administrator. If the Promotion is cancelled, modified, suspended, or terminated, notice will be posted on getitfree.us.
PRIZE: The total prize will depend on the amount of Easter eggs found on getitfree.us. Over the course of the Contest Period, a total of $300.00 USD (the “Prize”) will be hidden on getitfree.us. At the end of the Contest Period, the Prize will be divided evenly amongst the total amount of winners. If there is one winner, the Prize will be $300.00 to one Entrant, if there are two winners, the Prize will be $150.00 to each winner, if there are three winners, the Prize will be $100.00 to each winner, and so forth. Odds of winning a Prize are estimated to be 1:10,000.
Administrator reserves the right to disqualify any participant or winner and may refuse to award any Prize to a person who is ineligible, has violated any rule, has gained unfair advantage in participating in this Promotion, or has obtained winner status using fraudulent means. Potential winners must meet all eligibility requirements. If a potential winner is disqualified or declines the Prize, the total Prize will be split evenly between the remaining winners, or has obtained winner status using fraudulent means. Odds of winning a prize will depend on the total number of eligible entries received. Administrator anticipates that approximately 5,000 Entrants will participate.
PRIZE CONDITIONS OF ACCEPTANCE: There will only be one prize per winner. The winner will be notified as soon as the Easter egg pops up on their screen, and they receive confirmation from filling out the form completely and accurately. Each winner will be notified via the email address supplied on the entry form of the total Prize to be awarded. Each winner will also be sent a copy of Prize does not include any other item or expense not specifically described in these Official Rules, and all additional expenses, including, but not limited to, taxes if any, are the sole responsibility of the winner. Only the listed Prize will be awarded and no substitutions will be made unless if determined by and disclosed by the Administrator. Each winner is solely responsible for reporting and paying any and all applicable taxes, fees, and costs. Each winner must provide Administrator with a valid taxpayer identification number or social security number before any prize will be awarded.
If chosen, the winner will be required to click on a link provided in the winning notice email and respond to confirm their mailing address within 72 hours. Winners will further be required to electronically complete and agree to an eligibility and liability/publicity release prior to claiming their prize within 72 hours of issuance of the Prize. If these documents are not returned properly executed, are returned to Administrator as undeliverable, or if any given winner does not otherwise comply with the Official Rules, their Prize will be forfeited and split between any other winners.
GENERAL CONDITIONS: The Promotion is void where prohibited by law and is governed by the laws of the State of California. Administrator and their respective parents, subsidiaries and affiliates are not responsible for late, lost, delayed, unclear, unintelligible, incomplete, misdirected, or ineligible sales information, which will be disqualified, or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the Promotion which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in the Promotion. ANY PERSON ATTEMPTING TO DEFRAUD ADMINISTRATOR OR SPONSOR OR IN ANY WAY TAMPER WITH, DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION WILL BE DISQUALIFIED AND MAY BE SUBJECT TO CIVIL LIABILITY AND/OR CRIMINAL PROSECUTION.
LIMITATION OF LIABILITY & RELEASE: By participating in the Promotion, entrants agree to indemnify and hold harmless the Administrator and each of its respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, members, managers, officers, directors, shareholders, and employees (collectively, “Releases”) from and against any and all injuries, losses, damages, claims, and actions of any kind arising from or relating to participation in the Promotion, or acceptance, possession, use, misuse, or nonuse of the prize that may be awarded, including, without limitation, actual, direct, indirect, consequential, punitive, special, or other damages. IN NO EVENT WILL THE ADMINISTRATOR BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR PARTICIPATION IN, ANY PRIZE AWARDED IN CONNECTION WITH THE PROMOTION. WITHOUT LIMITING THE FOREGOING, ALL PRIZES, AND ALL MATERIALS PROVIDED ON OR THROUGH THE SITES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MISCELLANEOUS: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the participant and Administrator in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of California without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of California, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. Venue for the disposition of any legal action that may arise out of a claim relating to the Promotion shall be proper in the Southern District for the State of California. The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or Promotion Entity, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or Promotion Entity or the manufacturer or distributor of such product or service and, except as otherwise indicated no association or endorsement is intended or should be inferred.
